Welcome to Homezy (operated by Vistec Foods Private Limited) (“we”, “us”, “our”). These Terms & Conditions govern your access to and use of our website, mobile application and related services (collectively, the “Platform”). By using the Platform you agree to these Terms. If you do not agree, please do not use the Platform.

1. Platform & Services

Homezy is an online marketplace that enables independent home-chefs, bakers and snack-makers (“Chefs”) to offer prepared food and related services (“Products”) to customers (“Users”). We act as an intermediary and facilitator of transactions between Chefs and Users, and between Users and delivery or logistics partners.
We do not manufacture the food ourselves and do not assume direct responsibility for the preparation, hygiene, delivery or content beyond our role as platform operator.

2. User Accounts

To use certain features, you may need to register an account.
You agree to provide accurate, current and complete information, and to update it when necessary. You are responsible for all activity under your account, and for maintaining the confidentiality of your login credentials. We may suspend or terminate accounts for violations of these Terms or unlawful conduct.

3. Orders, Payments & Pricing

When you place an order, you agree to pay the total amount shown. Chefs set the prices of their Products. We may include delivery fees or platform service charges. All payments must take place using methods approved by us.
We handle payments on behalf of Chefs and/or delivery partners. You must not pay outside the Platform unless expressly permitted.

4. Cancellations & Modifications

Because food is prepared fresh, cancellations or modifications may be limited. Whether cancellations or changes are allowed will depend on the timing of the request and preparation status of the order, at the Chef’s discretion. Any such change is subject to our review.

5. Delivery & Risk

Delivery may be handled by us or by third-party logistics partners. Delivery times are estimates only and may vary due to traffic, weather, or other circumstances outside our control.
Risk in the Products passes to you once delivery is completed at the designated address. If you are unavailable to receive delivery, or if the address is incorrect, your order may still be marked as delivered and you may not be entitled to a refund.

6. Quality & Food Safety

Chefs are responsible for preparing food with reasonable hygiene and using permissible ingredients. However, as an intermediary platform we do not warrant that any Product will meet all of your expectations, or be free of allergens, or suitable for any specific dietary or medical condition. You are responsible for reviewing ingredient information and informing the Chef of dietary restrictions.
We are not liable for any claim arising from food consumption, allergens, or resulting health issues, beyond the extent permitted by applicable laws.

7. User Conduct

When using the Platform, you agree not to:

  • Upload, transmit or publish content that is defamatory, offensive, harassing, obscene, infringing of intellectual property rights, or otherwise unlawful;
  • Use the Platform for any commercial purpose outside of permitted uses;
  • Adopt methods that damage, intercept or interfere with the Platform, or misuse any accounts, bots, spiders or automated tools;
  • Mislead or impersonate others, solicit other users for commercial activities, or engage in spam, pyramid schemes, or any illegal activity.

We reserve the right to remove, suspend or block access to any content or accounts at our discretion.

8. Intellectual Property

All materials on the Platform (software, design, logos, text, images) are owned by us or licensed to us, and are protected by intellectual property rights.
You may print or download extracts for your personal use only. You may not commercially exploit or distribute these materials without our express permission.

9. Third-Party Links & Services

The Platform may provide links to third-party websites, services, or resources. We do not control these third parties, and we are not responsible for their content, terms, or practices. Use of these links is at your own risk.

10. Disclaimers & Limitation of Liability

To the maximum extent permitted by law:

  • The Platform and all content are provided “as-is” and “as-available” without warranty of any kind.
  • We do not promise uninterrupted, error-free service, or that product listings will always be accurate, current or available.
  • Our liability for any loss or damage arising in connection with your use of the Platform is limited to the value of the order placed through us (to the extent permitted by applicable law).
    We are not liable for indirect, consequential, incidental or punitive damages arising out of your use of the Platform, your interaction with Chefs or delivery partners, or your consumption of Products.

11. Indemnification

You agree to indemnify, defend and hold harmless Homezy, its officers, directors, employees, agents and affiliates from any claim, liability, loss, damage, cost or expense (including legal fees) arising from:

  • Your misuse of the Platform;
  • Your violation of these Terms or any applicable law;
  • Your dealings with Chefs, delivery partners or other users.

12. Changes to Terms

We may update these Terms at any time by posting revised terms on the Platform. Your continued use of the Platform after such updates means you accept the revised Terms. You should check for updates frequently.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable in India. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in Mumbai (or another city as per our registered office).

14. Miscellaneous

If any provision is held invalid or unenforceable, the remaining provisions will remain in full force. You may not assign these Terms or your account without our consent. We may assign our rights or obligations at any time. These Terms constitute the entire agreement between you and us regarding your use of the Platform.
